State agencies and offices are closed on legal holidays and employees are given the days off with pay. Private employers are not required to pay employees for holidays even if the business closes. If the business remains open, the employer does not have to pay a higher rate of pay to employees who are required to work and does not have to offer the employee other days off to make up for working on a holiday. Although there is no requirement to do so, many New Mexico businesses do offer employees paid holidays.
